By accessing or using the DoubtCheck website and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and DoubtCheck LLC ("DoubtCheck," "we," "us," or "our"). We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the modified Terms.

2. Eligibility

To use DoubtCheck, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into a binding agreement.
• Not be prohibited from using the Service under applicable law.
• Provide accurate and complete information when creating an account or conducting a search.

By using the Service, you represent and warrant that you meet all eligibility requirements. We may request proof of age or identity at any time and may suspend or terminate your access if you fail to comply.

3. Description of Service

DoubtCheck is a personal relationship verification tool that searches publicly available information on dating platforms to help users determine whether a specific individual has active dating profiles. Our service includes:

• Single Scan: A one-time search across 8 major dating platforms.
• Deep Scan: An enhanced one-time search with AI photo analysis, social media cross-referencing, and extended public records.
• Guardian Mode: An ongoing monitoring subscription that performs automatic re-scans every 7 days with email alerts for new profile detections.

By using DoubtCheck, you agree that you will NOT use the Service or any information obtained through the Service for:

• Employment screening or hiring decisions
• Tenant screening or housing decisions
• Credit eligibility determinations
• Insurance underwriting decisions
• Any purpose that would require compliance with the FCRA
• Stalking, harassment, or intimidation of any individual
• Any illegal purpose or activity
• Commercial purposes, resale, or redistribution of reports

Violation of these restrictions may result in immediate termination of your account, forfeiture of any refund rights, and potential legal action.

5. Accuracy of Information

DoubtCheck searches publicly available information from dating platforms and other public sources. While we strive for accuracy, we cannot guarantee that:

• All active dating profiles will be detected in every search.
• All matches identified are accurate (false positives may occur).
• Information from third-party platforms is current or complete.
• Dating platforms will not change their public data availability.

Reports are provided on an "as-is" basis. You acknowledge that results may be incomplete and should not be the sole basis for significant personal decisions. We recommend using DoubtCheck as one of multiple tools for personal relationship verification.

6. Payments and Billing

6.1 One-Time Purchases

Single Scan and Deep Scan are one-time purchases. Your card will be charged once at the time of purchase. There are no recurring charges for one-time purchases.

6.2 Guardian Mode Subscription

Guardian Mode is a monthly subscription billed at $14.99/month. Your subscription will automatically renew each month until you cancel. You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period.

6.3 Payment Processing

All payments are processed securely through Stripe. By providing your payment information, you authorize us to charge the applicable fees. We do not store your complete payment card details on our servers.

7. Refund Policy

We offer a 100% money-back guarantee on all purchases. If you are not satisfied with your results for any reason, you may request a full refund within 7 days of your purchase. To request a refund, contact us at [email protected] with your order details.

For Guardian Mode subscriptions, refunds apply to the most recent billing cycle only. Previous billing cycles are not eligible for refund after the 7-day window.

8. User Conduct

When using DoubtCheck, you agree to:

• Provide accurate and truthful information in your searches.
• Use the Service only for lawful, personal relationship verification purposes.
• Not attempt to circumvent, disable, or interfere with any security features of the Service.
• Not use automated scripts, bots, or other tools to access the Service.
• Not share your account credentials with third parties.
• Not use the Service to generate reports for commercial resale.
• Comply with all applicable local, state, national, and international laws and regulations.

9. Intellectual Property

The Service, including its design, text, graphics, logos, icons, images, software, and all other content, is the property of DoubtCheck LLC and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. You may download and print reports generated for you through the Service for your personal records. You may not reproduce, distribute, modify, or create derivative works from any content on the Service without our prior written consent.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOUBTCHECK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE.

12. Indemnification

You agree to indemnify, defend, and hold harmless DoubtCheck LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your use of the Service caused damage to a third party.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us. If you have an active Guardian Mode subscription, cancellation of your account will also cancel your subscription at the end of the current billing period.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
